Terms of Service

1. Acceptance

By registering or subscribing to Lendery (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

2. Nature of the Service

Lendery is a lead marketplace that connects lenders with borrower leads. Lendery is not a lender, does not make credit decisions, does not originate loans, and does not guarantee loan approval or any specific outcome.

3. Subscription & Billing

Paid access to the Service is provided on a monthly subscription basis at the price displayed at checkout (currently $149/month). A free trial of 2 days may be offered. After the trial ends, your card on file will be charged automatically each billing cycle unless you cancel.

All sales are final. No refunds are provided under any circumstances, including for unused time in a billing period, accidental renewals, or dissatisfaction with lead quality. You may cancel at any time to prevent future renewals.

4. Lender Responsibilities & Compliance

Lenders who use the Service are solely responsible for:

• Compliance with all federal and state lending laws including, but not limited to, the Truth in Lending Act (TILA), Equal Credit Opportunity Act (ECOA), Fair Credit Reporting Act (FCRA), Gramm-Leach-Bliley Act (GLBA), the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and state-specific licensing and consumer lending regulations.
• Their own credit underwriting, verification, and lending decisions.
• Obtaining any required consents before contacting borrowers.
• Proper handling, storage, and disposal of borrower information.

5. Data Use Limitations

Lead data is licensed for use in the lender's own loan origination activities. Lenders may not resell, redistribute, or provide lead data to unaffiliated third parties. Lead data is provided as-is without warranty of accuracy or completeness.

6. Prohibited Conduct

You may not (a) reverse engineer the Service, (b) scrape or automate data extraction beyond permitted export tools, (c) share account credentials, (d) use the Service for any unlawful purpose, or (e) use lead data for any purpose that violates applicable law.

7. Disclaimer of Warranties

THE SERVICE AND ALL LEAD DATA ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LENDERY DOES NOT WARRANT ACCURACY, COMPLETENESS, OR FUNDABILITY OF ANY LEAD.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENDERY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNTS PAID BY YOU FOR THE SERVICE IN THE TWELVE MONTHS PRIOR TO THE CLAIM. LENDERY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Indemnification

You agree to indemnify and hold harmless Lendery and its affiliates from any claim arising from your use of the Service, your lending activities, or your handling of lead data.

10. Termination

We may suspend or terminate accounts that violate these Terms. Upon termination, your right to access the Service ends immediately.

11. Changes

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance.
